Terms of service
These Terms of Service (hereinafter the “Terms”) set forth the conditions of use for the online store “Art-Hack Shop” (https://shop.art-hack.com/, hereinafter the “Store”) operated by Artleap Inc. (hereinafter the “Company”). Anyone who uses the Store (hereinafter the “Customer”) must agree to these Terms before using the Store.
Article 1 (Scope)
- These Terms apply to browsing the Store and to purchasing Products through the Store. In these Terms, “Products” means works of art created by artists (hereinafter “Artworks”) and items such as tote bags and drawstring pouches produced based on artists’ works (hereinafter “Goods”).
- The “Legal Notice under the Act on Specified Commercial Transactions,” “Shipping Policy,” “Refund Policy,” and “Privacy Policy” posted on the Store form part of these Terms.
Article 2 (Orders)
- Customers may order Products through the procedures prescribed by the Store.
- Minors must obtain the consent of a legal representative, such as a person with parental authority, before placing an order.
Article 3 (Formation of Sales Contract)
A sales contract is formed at the time the Company sends an order confirmation email in response to the Customer’s order.
Article 4 (One-of-a-Kind Nature of Artworks)
- As a general rule, all Artworks handled by the Store are one-of-a-kind.
- Artworks may also be exhibited and sold at physical stores and galleries. If it turns out that an Artwork cannot be delivered, for example because an order was received at almost the same time as an in-store sale, the Company will contact the Customer, cancel the order, and refund the full amount already paid.
Article 5 (Goods)
- Goods are products made based on artists’ works and, unlike Artworks, are not one-of-a-kind.
- Pre-order Goods are products that are shipped as soon as production is completed. The estimated delivery date is shown on each product page. If delivery is later than the estimate due to production or delivery circumstances, the Company will contact the Customer.
- If it becomes impossible to deliver pre-order Goods due to production circumstances, the Company will contact the Customer, cancel the order, and refund the full amount already paid.
Article 6 (Prices and Payment)
Product prices, charges other than the product price, payment methods, and payment timing are as set forth on each product page and in the “Legal Notice under the Act on Specified Commercial Transactions.”
Article 7 (Delivery)
The delivery timing, shipping method, and shipping fee for Products are as set forth in the “Legal Notice under the Act on Specified Commercial Transactions” and the “Shipping Policy.” Artworks on exhibition are, in principle, shipped after the exhibition ends. Pre-order Goods are shipped starting from the estimated delivery date shown on each product page.
Article 8 (Returns, Exchanges, and Cancellations)
The conditions for returns, exchanges, and cancellations are as set forth in the “Refund Policy.”
Article 9 (Product Display)
- We strive to convey the colors and textures of the actual items accurately in product images, but they may look different from the actual items depending on your screen and viewing environment.
- Images of Goods may include sample images created before production. The colors, pattern placement, and dimensions of Goods may differ slightly from the images and displayed information due to production circumstances.
Article 10 (Intellectual Property Rights)
- Copyright in an Artwork belongs to the artist who created it. The same applies to copyright in the works used on Goods. Purchasing a Product acquires ownership of the Product (a tangible object) and does not transfer copyright.
- Copyright in the images, text, audio, and other content posted on the Store belongs to the Company, the artists, or other rightful holders. Beyond private use and other uses permitted by law, Customers may not reproduce, republish, modify, or otherwise use such content.
Article 11 (Prohibited Acts)
In using the Store, Customers must not engage in any of the following acts.
- Acts that violate laws and regulations or public order and morals
- Registering false information or impersonating another person
- Purchasing Products in large quantities for the purpose of resale, or any other purchase that the Company deems inappropriate
- Acts that interfere with the operation of the Store, or acts that harm the rights or interests of the Company, artists, or third parties
Article 12 (Disclaimer)
- The Company is not liable for damages caused by reasons not attributable to the Company, such as failures of communication lines or systems.
- Where the Company is liable to a Customer for damages, such liability shall be limited to the price of the relevant Product, except where the Company has acted with intent or gross negligence.
Article 13 (Personal Information)
The Customer’s personal information will be handled in accordance with the “Privacy Policy.”
Article 14 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. If a dispute arises in connection with the use of the Store, the Tokyo District Court shall be the exclusive court of agreed jurisdiction for the first instance.
Article 15 (Changes to These Terms)
The Company may change these Terms as necessary. The revised Terms take effect at the time they are posted on the Store.
